Obteno — Terms of Service

1. Acceptance of Terms

By accessing or using Obteno ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Description of Service

Obteno provides AI-powered tools for content creators, including script generation, digital product creation, keyword research, email list building, sales page generation, and launch planning. Access is provided via a subscription plan billed monthly or annually through Stripe.

3. Subscription and Billing

Subscriptions are billed in advance on a monthly or annual basis. You authorise Obteno to charge your payment method on a recurring basis. Credits are allocated per plan and roll over each month while your subscription is active. If you cancel, any remaining credits expire at the end of your current billing period.

4. Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms and is the only statement of what we refund and when. Nothing in this section limits your statutory rights under the UK Consumer Contracts Regulations 2013 or equivalent EEA law.

5. Cancellation

You may cancel your subscription at any time via the billing portal in your account dashboard. Cancellation takes effect at the end of the current billing period. You will retain access to the Platform until that date.

6. Acceptable Use

You agree not to use the Platform to generate content that is illegal, harmful, defamatory, or in violation of any third-party rights. You are solely responsible for the content you create and publish using the Platform, including checking that any name, brand, image, quotation or excerpt you supply or publish is one you are entitled to use.

If you believe material on the Platform infringes your copyright, our Copyright & DMCA Policy sets out how to send a notice and how we respond. We remove infringing material expeditiously on a valid notice, and we terminate the accounts of repeat infringers in appropriate circumstances.

7. The Member Community

Paid plans include access to a private member community. Reading is available to paid members and members in an active trial; posting and replying is available to paid members only. You must be 18 or over to post. The Community Guidelines form part of these Terms, and posting means you accept them.

You keep ownership of what you post. You grant Obteno a non-exclusive, royalty-free licence to host, store, display and moderate it for the purpose of operating the community, which ends when the content is removed, save for copies retained as described below.

Posts are screened automatically, including by automated systems, before they become visible to other members. We may remove any post, and may bar an account from posting, at our discretion and without notice. Being barred from posting does not affect your subscription, your access to the tools, or any product you have created, and we will not withdraw a paid service as a consequence of a moderation decision.

Your chosen display name is visible to other members alongside everything you post. Your email address is not. Display names cannot be changed by members once set; email issac@obteno.com if yours needs to change.

If you close your Obteno account, your display name is deleted and your posts are attributed to "Former member" so that conversations other members took part in remain intelligible. You may instead ask for your posts to be deleted outright by emailing issac@obteno.com. Removed and deleted posts are retained internally for a limited period as a record supporting moderation decisions.

Posts are written by members, not by Obteno. We do not endorse them, and nothing posted by a member is advice from us. You are responsible for what you post, including that you are entitled to share it.

8. Intellectual Property

As between you and Obteno, everything you generate with the Platform's AI tools is yours. We claim no ownership over it, and we assign to you whatever rights we may have in it. You may use it, publish it, and sell it commercially, on any platform, with no revenue share and no further permission from us.

One honest caveat, because it affects what you can enforce against other people rather than anything we do: in the United States, material generated entirely by AI is not protected by copyright, because copyright requires human authorship — and selecting or refining prompts, however detailed, does not by itself create a copyrightable work. Your own writing, edits, images, structure and creative choices are yours in the ordinary way. So you are free to sell what you make here; you may simply have narrower rights to stop a third party copying the purely AI-generated parts of it. Other countries treat this differently.

Obteno retains ownership of the Platform itself, including its design, code, and underlying models.

9. Limitation of Liability

Obteno is provided "as is". To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform.

10. Governing Law

These Terms are governed by the laws of England and Wales.
