Obteno — Terms of Service

1. Acceptance of Terms

By accessing or using Obteno ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Description of Service

Obteno provides AI-powered tools for content creators, including script generation, digital product creation, keyword research, email list building, sales page generation, and launch planning. Access is provided via a subscription plan billed monthly or annually through Stripe.

3. Subscription and Billing

Subscriptions are billed in advance on a monthly or annual basis. You authorise Obteno to charge your payment method on a recurring basis. Credits are allocated per plan and roll over each month while your subscription is active. If you cancel, any remaining credits expire at the end of your current billing period.

4. Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms and is the authoritative statement of what we refund and when. In summary, two guarantees apply to every paid plan — Starter, Creator and Pro, monthly or annual — and to one-time purchases: (a) every charge carries its own 3-day window, within which we refund that charge in full, unconditionally and without asking why; and (b) a 60-day first-sale guarantee — if you have built at least one product in Obteno, listed it publicly for sale at a price, and still have not made a sale within 60 days of your first paid charge, you choose between continued hands-on help until you land a sale or a full refund of the subscription charges paid on that account in those 60 days. We do not deny a first-sale claim because you used your credits, downloaded your files or published your product; using Obteno is what qualifies you. Where this summary and the Refund Policy differ, the Refund Policy governs. Approved refunds are returned to the original payment method within 5-10 business days. Nothing in this section limits your statutory rights under the UK Consumer Contracts Regulations 2013 or equivalent EEA law.

5. Cancellation

You may cancel your subscription at any time via the billing portal in your account dashboard. Cancellation takes effect at the end of the current billing period. You will retain access to the Platform until that date.

6. Acceptable Use

You agree not to use the Platform to generate content that is illegal, harmful, defamatory, or in violation of any third-party rights. You are solely responsible for the content you create and publish using the Platform, including checking that any name, brand, image, quotation or excerpt you supply or publish is one you are entitled to use.

If you believe material on the Platform infringes your copyright, our Copyright & DMCA Policy sets out how to send a notice and how we respond. We remove infringing material expeditiously on a valid notice, and we terminate the accounts of repeat infringers in appropriate circumstances.

7. Intellectual Property

As between you and Obteno, everything you generate with the Platform's AI tools is yours. We claim no ownership over it, and we assign to you whatever rights we may have in it. You may use it, publish it, and sell it commercially, on any platform, with no revenue share and no further permission from us.

One honest caveat, because it affects what you can enforce against other people rather than anything we do: in the United States, material generated entirely by AI is not protected by copyright, because copyright requires human authorship — and selecting or refining prompts, however detailed, does not by itself create a copyrightable work. Your own writing, edits, images, structure and creative choices are yours in the ordinary way. So you are free to sell what you make here; you may simply have narrower rights to stop a third party copying the purely AI-generated parts of it. Other countries treat this differently.

Obteno retains ownership of the Platform itself, including its design, code, and underlying models.

8. Limitation of Liability

Obteno is provided "as is". To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform.

9. Governing Law

These Terms are governed by the laws of England and Wales.
